The Supreme Court of India has remarked that High Courts are not the custodians of the Revenue Department while staying an order issued by the Bombay High Court. The apex court observed that the High Court had overstepped its jurisdiction by interfering in matters related to revenue administration and policy, which fall within the domain of the executive.
The case involved a revenue-related dispute where the Bombay High Court had directed certain actions that, according to the Supreme Court, went beyond the judicial mandate. Emphasizing the principle of separation of powers, the Supreme Court noted that courts must exercise restraint when dealing with executive functions, particularly those involving taxation and revenue.
By staying the High Court’s order, the Supreme Court underlined that while judicial review is vital, it must not result in judicial overreach, especially in matters that require technical or administrative expertise.
